Miami Attorney Jonathan Schwartz, a former Dade Public Defender was found guilty of contempt of court and sentenced to 10 days jail, 6 months probation and a special condition that he take a Florida Bar course in professionalism. Schwartz was found guilty of contempt of court today by Collier County Judge Mike Carr, who found that Schwartz had taken $800.00 from a client, failed to appear for two scheduled court dates, and then did nothing when his client got a bench warrant.

Rumpole says, we don't know a whole lot about this case. We do know something about the defendant. We have interviewed several potential clients who all informed us that this attorney "guaranteed" that they would not go to jail. We actually have a lot more to say on this attorney's business practices and lack of professionalism and the disservice we believe he does to many of the clients who hire him. However, for now, we will let Mr. Schwartz serve his sentence and see what the Florida Bar does.
Lawyers can't guarantee clients that they won't be sent to prison; even when the lawyer is a client as well.

Years later, I have a couple of cases stolen from me or post- conviction motions filed (concerning me) and I disagreed with his tactics and discretion. It seemed that it was all a show to take money rather than reasonably envisioning a feasible legal action. I actually had a Capital Sex battery (anal, vaginal and oral penetration..with DNA and a willing victim) where I pled it to 11 and he filed a Rulel 3.850 b/c I did not file a motion for a downward departure. Nine is pretty south of [at the time] Life with a 25. I have seen his inability to act civil in an adverserial setting and that seems to be his downfall. He can be very smart, passionate and crafty but he is the classic "not seeing the forest through the trees" type of person. He also seems really, REALLY eccentric.
When he was a PD, his contempt episodes and judicial recussals were considered, by him a "badge of honor". He kept a booking photo of himself in his office.
No matter what you do, our job is never to go to jail for anybody. We are lawyers, not bodyguards. We are not suppsoed to take bullets for anyone. This is a profession and we are supposed to be advocates...not do anything, mercenaries!
For all you bleeding hearts, the main thing that Jonathan fulfills is the epitimizing of the backstabbing, do anything, say anything lawyer. That is bad for the profession. When you get a "life felony" client and tell them they need to wait 30 days for the "Arthur" hearing, how frustrating is it when client's say that they know a lawyer that, if they just pay x amount of dollars, they will get them out...(some editing by Rumpole- the full text is in the comments section)
Jonathan has spent over 20 years not respecting the perimeters that most other people must comply with. It is sad b/c he has the capacity and know-how to be a very fine lawyer. Out of court he is a very nice person. However, all of us that have seen him over the years could easily tell that one day he would mess with the wrong judge.

Couldn't have happened to a more deserving attorney. He is an embarassment to the profession. What an amoral classless jerk. Too bad it took a judge from outside our jurisdiction to really hammer him as he so richly deserves(though some of our Dade judges have yanked his chain).
He deserves it. From his first days as a PD, he never understood how to be a professional.
He is not a bad guy personally and he is very smart but his crazy mannerisms reduce any of his attributes.
He is the epitome of why lawyers are hated.

Schwartz is a horror show - but not the only one. Some are barely lucid, others will extort their clients for every 'extra' dollar, while too many are there only to scare the client into a fast plea.

I handled a speeding case in collier once. I drove over in person after a coverage attorney missed the first hearing. I don’t remember the judge’s name but he was nuts. The morning calendar is like a sounding if you maintained not guilty plea; the trail was in the afternoon. One ticket kills a whole day. At sounding pleas the judge supended no less than five drive licenses of defendants with one or two priors who plea no contest to to speeding. Things are different in collier, if you want to see the ticket or the record you must purchase a copy from the clerk.
Who here has never missed a court date? A judge can call. Your phone number is the pleadings. I think Collier Judges don’t want Miami attorneys practicing in Collier or they are just too harsh

There are players and player haters. Those of us who know Jonathan know that he cares dearly about those he represents. That he does not need to be working but continues to do so because he cares. That instead of walking up to the prosecutor and telling him or her that his client is an asshole but deserves less jail time, he actualy does what he is paid to do. He represent those who other attorney dare not.
The gossip about Mr. Schwartz is years old passed down from douce bag to douce bag in the time-honored tradition of those who have little capacity for self reflection and choose to express their self-laothing in the manner of playground children.

Incompetence is overlooked, and aggressive lawyering is condemned. It is a game of numbers. You don't hear from his satisfied clients because they don't call you...Empty cans make more noise.
Knowing this story would bring out the most vile of you, I dared check this blog to find that indeed it has doe just that. But alas it is late and some of your clients need lawyers.
1:09 am, you are wrong. A lawyer has an obligation to tell the client the truth about the case and assist him or her in preparing for the outcome of the case. In my PERSONAL experience in speaking with clients who have seen Mr. Schwartz or have been represented by him, he feeds them lines designed to get them to hire him. Sure you can tell a client you will file a motion to suppress, but you also have to tell them the probability of success.
What I see Schwartz doing over and over again is filling clients heads with motions to dismiss and suppress while charging fees in which he often GUARANTEES they will win or not go to jail. Of course he will not put this in writing.
Does he "care" about his clients? I have no idea. But the road to hell is paved with good intentions. Caring is not nearly enough. A lawyer needs to be honest, professional, and good. In my opinion, he has none of those attributes.

I to have had numerous clients over the years tell me stories of ridiculous promises made to them by Mr. Schwartz. In addition, i have spoken with some of his former associates whom he would dispatch to court for those clients. They tell the same story of being sent to court and finding themselves confronted by a client insisting he was promised by Schwartz that he would be getting a specific result. The promise is almost always an impossible one to keep("don't worry we will get your son out tomorrow even though he is on probation and was just arrested for armed robbery"). If, in fact, Mr. Schwartz need not work anymore, as one of the posts suggests, then he should do everyone(mostly his clients) a favor and retire!
Catalano has a first time DUI case in front of Lindsey. Defendant hit a MPD cop and totalled his police car. Cop is ok and has very minor injury.
Cops "bullied" state in demanding 120 days jail... on a FIRST DUI.
Lindsey would not offer plea from bench.
Client collapsed in court last week and 911 was called.
The State seems to allow the police to bully them too often.

So many violations of the "Golden Rule".

The story here is NOT Jonathan Schwartz and his bad lawyering; I do not think you will find one lawyer out there today that, given the facts of this story, would support Jonathan and his actions. He was wrong, dead wrong, for how he handled this case.
We all have our Jonathan Schwartz stories that we have heard, through rumor and innuendo and other clients walking through our door as well. (I have heard them from my clients more than once).
You, Rumpole, of all people, usually get the story; I am surprised you missed it here.
You missed it, because you have your personal feelings about JS. You are usually the journalist, the blogger that pushes the envelope and pulls the sheets off the real story, under the covers, so to speak.
The story is, that a Collier County Judge put a Dade County attorney in jail for 10 days.
Golden Rule 3 above; we have all screwed up at one time or another in our 5, 10, 15, 20 plus years as an attorney (fill in the blank). And, don't get me wrong, Jonathan SCREWED UP.
But, we are defense attorneys and we argue in court every day for mercy, mitigation, and weighing the wrong against the penalty.
In Dade County, Jonathan Schwartz would not have been sentenced to 10days in jail; he would not have gotten 10 hours in jail. And that, Rumpole, was the story.
Why is a Collier County Court Judge sentencing an attorney to 10 days in jail? Because, he wants to send a very clear message to the attorneys on the Atlantic Ocean side of this state; don't you dare even think about -ucking with us over here; don't you take business away from our attorneys here in sleepy Naples; stay over there and mind your own.
There are a number of attorneys in Dade and Broward that have been putting their business roots down and attempting to build a practice on the west coast. Traffic tickets attorneys, DUI attorneys, and others. And by doing so, they are taking business away from the locals.
Step back from your feelings about JS for a moment, and then write the rest of the story.

Anyone who has come into contact with Jonathan Schwartz knows that he is passionate about his practice and despite the ridiculous comments to the contrary about overcharging clients, there are many times that Mr. Schwartz has gladly taken many cases without receiving compensation and successfully resolved those cases for those clients. It is understandable that during these tough economic times attorneys with failing practices would want to badmouth one of the more successul criminal defense attorneys in Florida.

When I was a prosecutor, I saw him do things that made me cringe. Some were so insane that I can't even think of them without laughing. Perhaps if some of our judges took this crap more seriously and dealt with it earlier certain lawyers' careers, things wouldn't get as far as they have.

I am not rejoicing about Mr. Schwartz’ misfortune. Those who do and are rejoicing are wrong to do so, because any one of us can experience the intemperance of a “foreign” Judge. That said, however, some are rightfully expressing factual observations and poignant opinions. I will say there are others in our circle who stand on the same platform, awaiting the same petard as Mr. Schwartz, and are perhaps more deserving of the consequences, but such is fate.
Now, from personal experience, I can say Mr. Schwartz has garnered a less than admirable reputation. I have had Mr. Schwartz as a co-defense counsel in several cases, and it was “an experience” of the worst kind. His word or representation was worth less than a three-dollar bill! I have seen him irritate the most patient of jurists, and all defense counsel incur the wrath that followed!
I have also had him yank at least three cases from me after making promises he knew he were absurd and unattainable, and quoting a ridiculous “get them in the door” fee. The three clients all returned after their awakening, saying they wanted to switch lawyers, and asking me to again represent them. I declined each and every one of their invitation to re-engage. (Wise old man told me clients are like ex-wives, never taken them back) All these clients had similar stories, “I was promised” (me lo prometió) - “he assured me” (me lo aseguró) - “how can a lawyer do this” (como puede un abogado hacer esto). The theme was consistent, after promising the unsophisticated clients a result, as a selling point, and quoting a minimal fee, the clients were told the result was no possible, the quoted fee did not include trial, etc., etc., etc.
We all have had similar experiences with others in our world. We all know those who quote a low fee in contemplation of a plea, but when the plea is not forthcoming, oh well, we know. Example, there is one particular lawyer in our midst who has become notorious for quoting minimal fees only to plea out the client, with little work on the case. In one particular case, this attorney represented defendant number 1, who he a flip in Federal court; he then represented defendant number 2, who was the defendant on whom defendant number 1 had flipped; he then flipped defendant number 2, on defendant number 3, represented defendant number 3, whom he promptly flipped on others. Yes, he represented all three defendants, and you say there are no ménage à trois in the criminal system. Ironically, this was all done with the knowledge of the State Attorneys Office. So moral to the story, it is oftentimes not about substance, but more so about timing, personality, fate, or circumstances, you decide!

The issue cannot be whether a Dade judge would have imposed a similar sanction.
Schwartz was wrong, has been consistently wrong, and the defense Bar knows it. No one cared enough to act, now you are upset that he got any punishment at all? Why doesn't the criminal defense Bar collect up all the Schwartz stories it can and mail them to the Bar?
Rumpole is dead on. This is one bad apple who took a tiny hit - given his history.
I am proud of our profession. But not all of its members, or even of those who are apologists for the least honorable among us.

Captain, I think you miss the point. I don't think anyone is happy that Jonathan Schwartz was jailed for his actions. I agree that the judge may have been trying to send a message to Dade/Broward attorneys to stay on their side of the state (there's an article on The Florida Bar's website about a ticket attorney who got burned over there).
But the simple fact is that when Dade lawyers--on both sides of the aisle--and judges think of capable and ethical attorneys, the name Jonathan Schwartz does not come to mind. There may be a few dissenters out there, but I'd bet that at least 90% of the REGJB crowd agrees with Rumpole.
El Capitan we can agree to disagree, but let me say this: there are many situations where I can say "there but for the grace of the lord go I" but Mr. Schwartz's actions are not one of them. I do not conduct my self with my clients in any way shape or form like he does. Read the comments: attorney after attorney talking about how he stole clients from them by promising things he has no right to promise. Speak to his former "associates" about the sandbagging he did to them and how he lied to clients and sent them in to take the rap. 99.99% of all lawyers in Dade can practice in any courtroom in Dade or Broward. Mr. Schwartz is the only lawyer I know BARRED from at least a half a dozen courtrooms because Judges cannot be fair with his clients because of him. He needs to be removed from this profession, and that is the first time I have ever said that about any lawyer.
There is a difference between kicking someone when they are down, and applauding justice. I applaud the justice here. It has been long long long overdue.
BTW Captain- JS has been sentenced to jail in Dade, by Dade judges on more than one occassion. I can think of three off hand. And it was only the begging of his supervisors in the PDs office, or other lawyers showing up for him, that eventually got the Judge to back down.
Who can forget the entire CABA standing up and turning their back on Schwartz at a candidates meeting when Schwartz appeared when he announced to run against Judge SIlverman. And by the way, Schwartz was running for Judge in Dade at the time when he WAS ON PROBATION in Broward, which might be a first in the history of our State.
He's a bad apple. And if you know the heat Mr. Laeser has been giving me lately, even he and I agree. You're out on a lonely limb on this one.

No decent judge would sanction a lawyer for failure to appear. Mistakes get made daily.
The problem it that THIS lawyer is a real bad one and the judge was probably just sick of his bullshit.
Anyone who has ever come into contact with Jonathan knows that he will say and do anything to get a client and will lie to a judge with no remorse.
Ethics mean nothing to him. That is why he was fired by the PD. Hey, you gotta be real bad to get fired by the PD. They bend over backwards to keep people.

Also, as a fellow tribe member, he seems to exploit his judiasm. David Lee Roth, Wrestler Bill Goldberg, Joey Ramone, all the banking and entertainment industry, those are good jews. Doing the weird keepah in court thing, God told Moses that it is not a good thing and would prefer and end to the weirdness.

By the way 6/17/08 @ 2:14 p.m., that was a pretty unfair comment about the other lawyers. I have seen Andy Rier work pretty hard in that courthouse. I don't think he is selling anybody out.
I am not impying Jose deserves your knock b/c I am not sticking up for him. I simply have never tried a case or acted as co-cousnel with him. However, he is never bothered anybody to deserve your anonymous attack.
I would not know JS if I passed him in the hall, but about a year ago I had someone contact me about a case that he had been appointed the SAPD on (drug case w/ a min man). The client said that he kept "promising" him that the charges would be dropped IF he would retain him as PRIVATE COUNSEL. He eventually hired Robbins, Tunkey, Ross.
Rumuor is fake j schwartz spoke to the commissioner of the blogger association, but a deal couldnt be struck. Fake js wanted full salary up front to play, with no guarantee on whether he'd show up. No word yet on the collier league, but we here he has made a ten day trip to collier to see if they will sign him.
Another favorite JS technique was to show up in court on an appointment and act like it was a very strange occurrence but then agree-like it was a fun thing to take an appointed case- to do it for the heck of it. Like the client was getting some great lawyer by happenstance. I saw him do this in two or three courtrooms within two days and it was disgusting. And he used the same line- he would call the case and say "judge apparently your JA called me to take this case. And me and my associates were sitting around and we can't figure out why we were called, but then we decided to take the case anyway."
It was putrid BS.
He also has weird stuff going on in his firm. At one point he had a "senior associate" who had never tried a case (but had been hired before the junior associate who had tried 100 felony cases) and the junior associate had to clear all his decisions with the senior associate. Like he was running some real law firm instead of a two bit clip joint.
He's a loser, a thief, and he uses his position as an attorney to prey on clients, much like what Scott Saul detailed when JS filed a rule 3 on a case Scott got the client 9 years on.
I don't like kicking people when they are down, but as Rumpole said, this is more of someone getting his just desserts.

Every ASA with half a brain quickly learns to never trust Jonathan Schwartz, and to never believe a thing he says. I viewed him as a hack who regularly lied and filed crazy shit long before my stint in County Court was up.

I read this blog sporadically, say once a month. Just don't have the time between work (trials, waiting in line at REG and family). Please take no offense Rump, it's just the nature of life. But here I can't resist.
I was in court within the past couple weeks. Sounding calendar starting at 8:30 in front of Judge Dava Tunis. There was a line of private attorneys; joking around and back and forth with the judge. Suddenly, Yuhuda Bruck is at the podium. The tone of the courtroom changes. End result is a 3-4 year old case is the issue with double digits continuances. The judge hits the roof.I started thinking JT has gotten to her.
Response by Yuhuda is literally: but judge, I took 5 depos in the last 2 years. She has an incredulous look on her face and finally says something like: I'm tired of you coming in here waving papers without filing motions; act like a lawyer. This was the best part: she goes act like a lawyer. I'm a judge, not a law professor. File Rules and I'll grant them. Then she says: you have 2 weeks. Your #1 for trial. Enough is enough. Lawyers from the PDs office take those 5 depos in a day. If your client were in custody, I bet it wouldn't take years to get the depos done.
I saw the whole courtroom change, more calmly, when that was over. Saw similar experiences with the JS firm in J. Diaz, leesfield , Mendez, and Soto over the past number of months.
It all speaks for itself.
Look at all the attorneys who have written awful things about JS. The only one to say something nice about him is his little flunky Yahuda Bruck who was a snot-faced ASA and is now a snot-faced defense attorney following in JS's footsteps. The main difference between them: JS may lack morals but at least he has a brain. He just chooses not to use it. Any Dade County attorney that takes a DWLS case in Collier County for $800.00 doesn't deserve 10 days in jail. They deserve 30 days jail!!!
Many of us have asked Bruck to leave JS and he says he has no problem with him.
Bruck is a nice kid and sooner or later will get the hell out of there.
Schwartz is absolutely one of the biggest liers to ever appear before a judge.

Yehuda Bruck was actually quite a good ASA. Always loved to try cases and was smart and creative. Why he hooked up with Schwartz I'll never understand. I guess the money must be good.

Brock was offered $80,000 to work for JS after leaving the state. I have seen Brock and Sonja and they are always full of excuses as to why a case must be continued. I personally have a client in jail right now that keeps mentioning the promises made by JS.

Not defending JS, but those Collier County judges really know how to home town Miami lawyers. They have a completely different way of looking at things in those small towns.

It looks like JS has already been released from jail.
With the majority of us being criminal defense attorneys, its interesting to see how many have convicted him based on his priors and reputation rather than the facts. I have a similar low opinion of him. But not sure of the facts on this particular case. My understanding is the Defendant was the one who failed to appear and that he always arranged coverage, but there was a coverage failure. Same facts but with a respected attorney, I bet we would be protesting the Collier judge. Well, then again, it's JS, so who gives a fuck.
Sorry to kick a man when he is down but, that is not a very nice man.

I am a former ASA. We were all told over and over that no matter what he says, do not believe him.
He then did it to me. He lied to the judge and got caught.

I think it's quite an embarrassment that after all the posts made only a few can spell Yehuda Bruck's name correctly. He is a great attorney and seems to get the job done.
Not too fair and balanced. When Jonathan's case is unanimously thrown out on appeal; when Judge Carr is spanked by his the Circuit Panel by a vote of 3-0 last year; and when the Florida Bar makes a finding of no probable cause that any ethics violation occurred, no follow up is printed. Not to mention any of the supportive and positive comments that you selectively failed to publish. Whatever issue you have with Jonathan is long history, let it go. Fact is, despite your ranting and raving, he's still the most successful criminal attorney in Miami.
I'd have to agree. Love em or hate em, sounds like Schwartz deserves an apology or at least a correction to this one.
True, I know Jonathan real well for many years, and whatever he was or did 10-20 years ago is not who he is today. He has an extremely loyal clientele for over 25 years, and for good reason, he delivers. He gets the job done.
